Terms of Use

These Terms govern your access to nammachat.com, the NammaChat mobile applications, regional group chats, private chats, profiles, and related services.

1. Acceptance of these Terms

By creating an account, accessing, or using NammaChat, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply whether you browse, register, join a regional group, send a private message, or use another feature.

You must use the Service only in accordance with applicable law. You may not help another person evade these Terms, a suspension, a ban, or a safety restriction.

2. Eligibility

  • You must be at least 18 years old and legally capable of entering into these Terms.
  • You must not use NammaChat where access to the Service is prohibited by law.
  • If we previously removed or permanently banned you, you may not create another account without written permission.

3. Accounts and genuine identity

Provide accurate registration information and do not impersonate another person or create misleading profiles. You are responsible for activity performed through your account and for keeping your password, device, and verification information secure.

  • Do not sell, rent, transfer, or share access to your account.
  • Do not create fake profiles intended to deceive, harass, manipulate, or defraud users.
  • Tell us promptly if you believe your account has been accessed without permission.
  • We may require verification or restrict an account when needed for safety or compliance.

4. Your profiles, photos, and messages

You are responsible for profile details, photos, group messages, private messages, links, and other material you submit (collectively, “Content”). You must have the rights and permissions needed to submit that Content.

You retain ownership of your Content. You grant NammaChat a limited, non-exclusive, worldwide licence to host, store, reproduce, process, and display it only as reasonably necessary to operate, secure, moderate, and improve the Service or comply with law. This licence ends when the Content is deleted from our systems, subject to lawful retention, backups, safety records, and technical limitations.

We do not endorse user Content and cannot guarantee that it is accurate, safe, lawful, or appropriate. Automated moderation and system-generated service activity may be used to support safety, onboarding, and operation of the Service.

5. Community conduct and prohibited activity

Do not use NammaChat to create, upload, request, promote, or distribute:

  • Harassment, bullying, stalking, threats, blackmail, intimidation, or targeted abuse.
  • Hate speech or discrimination based on religion, race, caste, ethnicity, nationality, sex, gender, sexual orientation, disability, or another protected characteristic.
  • Content promoting terrorism, violent extremism, criminal activity, communal hostility, or violence.
  • Sexual exploitation, non-consensual intimate content, obscene material, or any content that exploits or endangers a child.
  • Spam, flooding, unsolicited advertising, deceptive promotions, malware, phishing, or attempts to disrupt the Service.
  • Impersonation, forged evidence, manipulated content intended to deceive, or false accusations presented as fact.
  • Another person's private information, images, communications, or identity documents without lawful permission.
  • Phone numbers, email addresses, WhatsApp or Telegram details, social-media IDs, home addresses, payment details, external contact links, or similar personal data intended to move unknown users off-platform.
  • Requests for money, loans, donations between users, investment schemes, gambling, payment collection, or financial solicitation.
  • Any content or conduct that violates applicable law or another person's rights.

Respectful discussion is permitted, but preaching, recruitment, inflammatory religious or political provocation, and attacks intended to create hostility or public disorder are not.

6. Personal safety and off-platform interactions

Chats may contain inaccurate, offensive, deceptive, or harmful material. Other users may misrepresent themselves. Use caution and report suspicious behaviour. Do not send money, disclose sensitive information, or meet another user based only on information provided in NammaChat.

You are responsible for decisions to communicate, call, message, pay, meet, or interact outside the Service. To the extent permitted by law, NammaChat is not responsible for voluntary off-platform transactions or interactions between users.

7. Reporting, moderation, and law enforcement

We may review reports and available account or Content information; remove Content; restrict features; suspend, disable, or terminate accounts; preserve relevant records; and take other proportionate action to protect users and the Service. Moderation decisions may consider severity, context, repetition, legal obligations, and safety risk.

We may disclose or preserve information when required or permitted by valid law, legal process, or a lawful request from an authorised agency, including under applicable Indian law such as the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, and the Bharatiya Nagarik Suraksha Sanhita, 2023. We do not promise that every report will lead to removal, suspension, or disclosure.

8. Advertisements, purchases, and donations

NammaChat may display third-party advertisements. An optional ad-free purchase may be offered for a stated period and price through Google Play or Apple's App Store. Platform billing, cancellation, and refund rules may also apply. An ad-free purchase removes the specified ads only for the displayed validity period and does not create ownership of the Service.

Any official support or donation option will be clearly identified by NammaChat. Users may not solicit or collect money from other users through chats. Never transfer money in response to a chat message claiming to represent NammaChat staff.

9. Service availability and third parties

The Service is provided on an “as available” basis. Features may change, pause, or stop, and messages or account data may be delayed, lost, unavailable, or removed. We do not guarantee uninterrupted access, error-free operation, message delivery, a minimum number of users, or any particular result from using NammaChat.

Links, advertisements, app stores, payment services, and other third-party services are governed by their own terms and policies. NammaChat does not control those services.

10. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, NammaChat disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or secure operation. Nothing in these Terms excludes a warranty, remedy, or liability that cannot lawfully be excluded.

To the maximum extent permitted by law, NammaChat will not be liable for indirect, incidental, special, consequential, or punitive loss arising from user Content, use or inability to use the Service, unauthorised access, off-platform interactions, or dealings between users. You remain responsible for your conduct and Content.

11. Suspension and termination

You may stop using NammaChat at any time. We may suspend or terminate access, remove a group membership, or restrict features when we reasonably believe these Terms were violated, an account creates risk, or action is needed to comply with law. Serious or repeated violations may result in a permanent ban. Ban evasion may lead to removal of all related accounts.

12. Changes to these Terms

We may update these Terms to reflect changes in law, safety practices, or the Service. The updated date will appear at the top of this page. Where required, we will provide additional notice. Continued use after updated Terms take effect means you accept them.

13. Governing law and disputes

These Terms are governed by the laws of India, without limiting any mandatory rights you may have under applicable consumer law. Courts with lawful jurisdiction in India will have jurisdiction over disputes, subject to any dispute process that applicable law requires. If one provision is unenforceable, the remaining provisions continue in effect.
